By accessing or using JobSurf ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms are governed by the laws of British Columbia, Canada.
JobSurf provides career guidance tools including roadmap generation, an AI career coach, job matching, and application tracking. These tools are powered by machine learning models and AI systems.
You must be at least 13 years old to use JobSurf. If you are under 18, you must have parental or guardian consent. By using the Service, you confirm that you meet these requirements and that all information you provide is accurate.
JobSurf's AI-generated content, including roadmaps, fit scores, task suggestions, and AI coach responses, are suggestions only. Nothing produced by the Service constitutes professional career, legal, financial, immigration, or educational advice, and no advisor-client, attorney-client, or fiduciary relationship is created by using it.
Fit scores are produced by a large language model comparing the profile information you provide against its general knowledge of the requirements of a given path. A fit score is not a probability of success, an acceptance rate, or a prediction of any outcome, and JobSurf does not hold outcome data for the paths it suggests. AI output can be incomplete, outdated, or wrong, including about requirements, costs, deadlines, timelines, and eligibility. Verify anything you intend to act on against the official source for that programme, employer, licensing body, or government agency before relying on it. You are solely responsible for decisions made based on JobSurf's output, and JobSurf is not responsible for outcomes of applications, interviews, admissions, or any decision made by a third party.
Free users receive 10 credits per month, resetting on the first of each calendar month. Credits are non-transferable and non-refundable, and unused credits do not roll over. Premium subscriptions are billed monthly at $3.99 USD and may be cancelled at any time through the account portal. No refunds are issued for partial months.
Cancelling stops future billing but does not end your access early: you keep Premium through the end of the period you already paid for, then the account reverts to Free. No partial refunds are issued for the remainder of a billing period. Re-subscribing after cancelling carries no penalty or waiting period. We may change subscription pricing or credit allowances with notice; continued use after a pricing change takes effect constitutes acceptance of it.
You retain ownership of the information you submit (profile details, resume text, testimonials, tracker entries). By submitting it, you grant JobSurf a licence to use it to operate the Service, including generating your roadmaps and, where you separately submit a testimonial, displaying it publicly if approved. You are responsible for the accuracy and legality of anything you submit, and must not upload content that infringes another party's rights or that you do not have the right to share.
You agree not to misuse the Service: no scripted or automated abuse of credits or rate limits, no attempting to circumvent security or access controls, no scraping, and no using the Service to generate content that is illegal, harassing, or fraudulent. We may suspend or terminate an account that violates these terms, engages in abusive automated use, or is used for a purpose the Service was not built for, with or without notice depending on severity.
The Service depends on third-party providers, including Supabase (database/authentication), Stripe (payments), Vercel (hosting), OpenAI (AI generation), Resend (transactional email), and Adzuna (job listings). We are not responsible for outages, errors, or data handling by these providers beyond our agreements with them, and their availability can affect the availability of features of the Service.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific outcome (a job offer, admission, or award) will result from using it.
To the maximum extent permitted by law, JobSurf's total liability to you for any claims arising from use of the Service shall not exceed the total subscription fees you paid in the 12 months preceding the claim, or 20 CAD if you have not paid any fees. JobSurf is not liable for any indirect, incidental, consequential, special, or punitive damages, including lost income, lost opportunities, or damages arising from a decision made in reliance on AI-generated output.
You agree to indemnify and hold JobSurf harmless from claims, damages, and expenses arising from your violation of these terms or your misuse of the Service.
These terms are governed by the laws of British Columbia, Canada, and the federal laws of Canada applicable therein, including PIPEDA. Any disputes shall be resolved in the courts of British Columbia.
If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms, together with the Privacy Policy, are the entire agreement between you and JobSurf regarding the Service. You may not assign your rights under these terms; we may assign ours in connection with a merger, acquisition, or sale of assets.
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify users of material changes via email.
